1. ELECTRONIC RECORDS

By using the Services, you agree to receive important information electronically. This includes the Agreement, notices, disclosures, policies, and other materials, which will be provided in electronic form rather than on paper, in accordance with The Electronic Signatures in Global and National Commerce Act. This consent applies to all types of materials that we are required to provide to you.

We'll deliver Electronic Records either directly on our Sites and Services or to the email linked with your account. It's recommended to save and print all Electronic Records for your reference. If you encounter any difficulties in printing, downloading, or accessing these records, feel free to reach out to us in writing at the provided address. To ensure you can access and store Electronic Records from us, you'll need the following hardware and software: a computer or compatible device capable of reading html and text files, internet connectivity via modem or equivalent means, a browser that can navigate to and display our Company website, and the ability to receive and view emails. Additionally, to print Electronic Records, you'll require access to a printer.

2. ELIGIBILITY

By using or accessing the Services, you confirm and assure that: (a) you are at least 18 years old; (b) you have no felony convictions or any criminal record involving sexual offenses, nor are you mandated to register as a sex offender with any governmental body; (c) you have not been previously banned or expelled from the Services; (d) you possess the legal capacity and authority to agree to this Agreement and comply with all its terms and conditions; (e) you are not a competitor of ours and are not utilizing the Services for purposes that compete with us or deviate from their intended use; and (f) you are not situated in, under the jurisdiction of, or a citizen or resident of any country subject to U.S. embargoes, identified as a "Specially Designated National," or listed on the Commerce Department’s Table of Deny Orders.

3. USE OF THE SERVICES

By using the Services and posting any content through them, you agree to do so in accordance with this Agreement and all relevant local, state, national, and international laws and regulations, including United States export control laws. The use of the Services is not allowed where prohibited by law.

a) Member Profile: Upon registration, you shall create a single unique profile solely for accessing the Services. Your profile, as well as any publicly viewable User Content or communications related to your use of the Services, shall not contain telephone numbers, street addresses, URLs, multimedia, artwork sourced from external platforms, email addresses, or any other form of contact information. Moreover, your last name shall not be disclosed in your dating profile. By using the Services, you acknowledge and consent that any information you opt to make publicly accessible may be viewed by anyone.

b) You are accountable for safeguarding the confidentiality of your account's username and password. You bear full responsibility for all activities conducted under your username and password, including any purchases of our Paid Services. You agree to: a) Immediately inform us if you suspect any unauthorized use of your username or password or any security breach. b) Ensure that you log out from your account after each session. c) Refrain from using another user's account, profile, username, or password. d) Exercise caution when accessing your account from a public or shared computer to prevent others from accessing or recording your password or personal information. You acknowledge that we are not liable for any losses or damages resulting from the theft or misuse of your username or password. We advise you to employ a strong, unique password for your account, refrain from reusing passwords across multiple platforms, and regularly update your password for added security.

c) You agree to use the Services solely for personal purposes and not for any commercial activities. You shall not permit others to access or use the Services on your behalf, nor shall you attempt to transfer your right to use the Services to any other individual or entity.

d) Interactions with Other Users: You acknowledge that when using our Services, you assume all risks associated with online or offline interactions with others, including dating. We currently do not routinely screen our users, verify their information, or conduct criminal background checks. However, we reserve the right to do so at our discretion, including searching sex offender registries. You understand that we are not obligated to perform such investigations. We make no guarantees about user conduct or compatibility. Some users may not be available for matching, and we may create test profiles to monitor our Services. You agree to take necessary precautions when meeting other users, including reviewing our online dating safety tips. These tips provide general advice for safer dating practices, such as not sharing personal or financial information and stopping communication with anyone who pressures you. You also agree to treat all users with dignity and respect and abide by our user conduct rules.

e) You agree not to use the Services for commercial solicitation or advertising purposes. This includes refraining from sending unsolicited emails, chain letters, or spam to other users. Furthermore, you will not use any information gathered from the Services to contact, advertise to, solicit, or sell to any user without their explicit consent beforehand.

f) User Conduct: By using the Services, you acknowledge and agree to the following: 1. Do not engage in unlawful activities or actions that harm or infringe upon the rights of others. 2. Avoid any form of harassing, obscene, intimidating, threatening, predatory, or stalking behavior. 3. Refrain from actions that disrupt, damage, disable, overburden, impair, or interfere with the performance of the Services. 4. Do not attempt to compromise system integrity or security, or intercept transmissions to or from the Service servers. 5. Do not impersonate any person or entity or misrepresent your identity or affiliation. 6. The Services must not be used for commercial purposes or to endorse political, religious, or unlawful activities. 7. Do not deceive or defraud other users. 8. Respect others' privacy and do not share personal information without consent. 9. Avoid engaging in gambling, illegal activities, or similar unlawful behavior. 10. Do not use automated tools to access or scrape the Services, or impose unreasonable loads on our infrastructure. 11. Do not collect personal information from individuals under 18. 12. The Service should not be used for phishing, trolling, or similar malicious activities. 13. Do not redirect users to other sites or promote such actions. 14. Do not harvest email addresses or engage in spamming activities. 15. Unauthorized access to Services or restricted areas is prohibited. 16. Do not bypass measures implemented to restrict access or usage of the Service. 17. Your account is for your use only; do not allow others to access the Services through your account. 18. Do not upload malicious software or invalid data through the Services.

g) To report any breaches of this Agreement by others, including Members, you can utilize the "Report This Profile" button or a similar feature on the Services. Alternatively, you may reach out to us directly.

h) Verification and Enforcement. While we typically do not conduct criminal screenings of our users as a routine practice, you acknowledge that we reserve the right to do so at our discretion. By using the Services, you consent to such screenings and agree to provide us with complete, accurate, and up-to-date information to confirm your eligibility for using the Services. You understand and agree that if the Company, at its sole discretion, determines that you have violated the terms of this Agreement, misused the Services, or engaged in behavior that could be deemed inappropriate, unlawful, illegal, or unsafe, the Company may, among other actions, investigate, take legal measures against you, and/or terminate your account, as well as cancel your subscription and/or membership.

4. USER CONTENT

By using the Services and posting any content through them, you agree to do so in accordance with this Agreement and all relevant local, state, national, and international laws and regulations, including United States export control laws. The use of the Services is not allowed where prohibited by law.

a) You bear full responsibility for the content and information you share on our platform, including messages, photos, videos, and other materials (referred to as "User Content"). We do not manage, endorse, or accept liability for any User Content, whether posted by you or others. The Company is not accountable for any errors, defamation, obscenity, or other inappropriate content encountered on the platform. Your use of the services is entirely at your own risk.

b) You agree to provide accurate and up-to-date information on your dating profile, including recent photos of yourself taken within the last two years. You acknowledge that all images posted on your profile are of you, and you commit to updating your profile accordingly. Additionally, you may need to provide specific information and upload a current photo of yourself to access the Services.

c) The Company does not have an obligation to screen, monitor, or control User Content posted by users. It is not responsible for User Content provided by others. However, you agree that the Company may, at its discretion, review, edit, reject, or delete User Content without notice, and you are solely responsible for backing up and replacing any User Content you post or store on the Services at your own expense. This also includes the Company's right to modify or adjust any photos you submit to adhere to its policies and procedures.

d) The Company doesn't claim ownership or control of your User Content, except as stated otherwise herein, on the Services, or in a separate agreement. By submitting or posting User Content, you grant the Company, its affiliates, licensees, and successors an irrevocable, perpetual, non-exclusive, transferable, fully paid, royalty-free, worldwide right and license to use, copy, publicly perform, publicly display, reproduce, adapt, modify, distribute, publish, list information regarding, translate, and syndicate such User Content provided by you. This includes preparing derivative works or incorporating such information and User Content into other works, and granting and authorizing sublicenses of the foregoing in any medium. You warrant that the User Content and its public posting and use by the Company won't infringe or violate any third-party rights, including intellectual property rights or rights of privacy or publicity, or cause harm to any third party or violate this Agreement. You further warrant that you have written consent from each identifiable natural person in your User Content to use their name, voice, or likeness as contemplated by the Service and this Agreement, and each such person has released you from any liability arising from such use. By posting User Content, you release the Company, its agents, and employees from any claims that such authorized use violates your rights, and you understand that you won't be entitled to additional compensation for any use of your User Content.

e) You agree not to share, reproduce, or modify any copyrighted, trademarked, or proprietary information without obtaining prior consent from the owner. This includes refraining from posting, copying, distributing, or creating derivative works from user-generated content or any other materials accessible through the Services, whether or not they are explicitly identified as copyrighted.

You agree not to share any User Content that breaches third-party rights, violates laws or regulations, or contravenes Company policies. Prohibited Content includes: i. Material that is obscene, pornographic, profane, defamatory, abusive, offensive, indecent, sexually explicit, threatening, harassing, misleading, fraudulent, or illegal. ii. Content that promotes racism, bigotry, hatred, or physical harm against individuals or groups. iii. Material intended to harass or intimidate users or third parties. iv. Content that infringes upon patents, trademarks, trade secrets, copyrights, or other intellectual property rights, including unauthorized use of copyrighted materials. v. Material containing images or recordings of individuals without their explicit written consent, violating their privacy or publicity rights. vi. Content that facilitates illegal activities, such as providing instructions on making or purchasing illegal weapons or drugs. vii. Violations of data privacy or protection rights. viii. Content containing harmful software or code, such as viruses, trojans, worms, or other malicious elements. ix. Any form of advertising, fundraising, or promotional content. x. Content deemed objectionable or which impedes others from using or enjoying the Services, or poses harm or liability to the Company or its users, as determined solely by the Company.

g) When you submit any questions, comments, feedback, suggestions, success stories, ideas, plans, notes, drawings, original or creative materials, or any other information related to the Company and our Services (collectively referred to as "Submissions"), they become the property of the Company, separate from the User Content you provide while using the Services. These Submissions, whether posted on the Services or sent to the Company via email or another method, are not confidential. By making Submissions, you agree to transfer all rights, including intellectual property rights, to the Company. The Company has the right to use and share Submissions without acknowledgment or compensation to you, for any purpose, commercial or otherwise.

h) Users are able to deleted their data or delete account. To delete the data need to request or contact us.

5. PRIVACY

By utilizing our services, you acknowledge and accept our Privacy Notice, detailing how the Company gathers, utilizes, safeguards, and reveals personally identifiable information from users. You comprehend and agree that any personal or private content, information, or material you share in your profile or in public areas of the Company will be shared with others accordingly. Moreover, any information or content you provide to the Company intended for sharing with other users will also be disseminated accordingly, and you hereby give your consent to such sharing. Your use of the Services indicates your consent to the collection, utilization, and disclosure of your personally identifiable information and aggregate data as outlined in our Privacy Notice. Furthermore, you consent to the collection, utilization, transfer, and processing of your personally identifiable information in the United States or any other country where we process your data or provide the Services. Additionally, you agree to receive emails from us related to the use or promotion of the Services.

6. INTELLECTUAL PROPERTY RIGHTS AND LIMITED LICENSE

All materials within or exchanged through the Service, excluding User Content, such as software, images, text, graphics, designs, illustrations, Company logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, information, data, and other files, including the arrangement thereof, as well as User Content belonging to other users ("Proprietary Materials"), along with all associated intellectual property rights, are solely owned by the Company and its licensors (including other users who contribute User Content to the Service). Unless explicitly stated otherwise in this Agreement, no provision herein shall be construed as granting a license to any of the Company's intellectual property rights.

You are granted a limited, non-transferable license to use the Services within the bounds set by the features and conditions of this Agreement. You agree not to: (i) alter, distribute, or reverse engineer any part of the Services or associated materials; (ii) replicate any portion of the Services without prior written consent; (iii) use any means to divert traffic away from the Services; (iv) commercially exploit the Services; (v) employ data mining or similar methods to extract content from the Services; (vi) manipulate identifiers to obscure information transmitted through the Services; (vii) automate account creation or access; or (viii) misuse the Services or materials. Unauthorized use violates this license and may also breach relevant laws. This Agreement does not grant any intellectual property rights beyond those expressly stated. The Company retains all rights not explicitly granted herein. This license is subject to revocation at any time.
